1. Agreement to Terms

By accessing or using Impossible To Name ("Platform", "Service", "we", "us", or "our") at impossibletoname.com and app.impossibletoname.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

What We Provide

The Platform is a document preparation and organization tool designed to help individuals prepare visa application packets for European immigration pathways. We currently support Spain's Digital Nomad Visa, Portugal's D8 Visa, and the Netherlands' DAFT treaty visa. We provide:

  • Assessment tools to identify potential visa pathways
  • Document checklists and organization systems
  • Form-filling assistance that pre-populates government PDF forms based on your inputs
  • General information about visa requirements and processes
  • Referrals to vetted partner services including translation, insurance, banking, and housing
  • Personalized cover letters and timeline guidance
  • Email support for questions about your documents or application process

What We Do NOT Provide

  • Legal advice or immigration consulting services
  • Review or verification of your documents for legal compliance
  • Guarantees of visa approval or successful immigration outcomes
  • Representation before any government agency, consulate, or embassy
  • Filing or submission of applications on your behalf

We are not a law firm. We do not practice immigration law. Nothing on this Platform constitutes legal advice. Our Service is designed for standard, straightforward visa cases only.

3. User Responsibilities

You Are Responsible For

  • Accuracy: Ensuring all information you provide is true, complete, and accurate.
  • Verification: Verifying all requirements with the relevant consulate or embassy before submitting your application.
  • Review: Carefully reviewing all generated documents, pre-filled forms, and cover letters before using them.
  • Compliance: Complying with all applicable laws and immigration regulations.
  • Updates: Staying informed about changes to visa requirements, as consulates update requirements periodically.
  • Professional Advice: Consulting with a licensed immigration attorney if you have any questions, concerns, or complexity in your situation.

You Acknowledge

  • Visa requirements vary by consulate and change over time without notice
  • We cannot guarantee our information is current or complete for your specific situation
  • You have final responsibility for the accuracy and completeness of your application
  • Government agencies make the final decision on your application, not us
  • Income thresholds, documentation requirements, and fee amounts are subject to change

Document Modifications After Download

Documents generated by the Platform are provided based on the information you supply during the wizard process. We retain a copy of all originally generated documents. You may review and edit documents after download. Any modifications you make to generated documents after download — including changes to government forms (PDF) or supporting documents (Word) — are solely your responsibility. The Platform is not liable for application rejections or delays resulting from user modifications to generated documents. Our refund policy applies only to defects in the originally generated documents, not to user-modified versions.

4. Eligibility and Edge Case Filtering

Our Service is designed for standard, straightforward visa applications. Our assessment tool may identify situations that require professional legal assistance ("edge cases"), including but not limited to: criminal history, complex income structures, prior visa denials, unusual family situations, or dual citizenship complications.

If our assessment identifies your case as an edge case, we will recommend you consult with a qualified immigration attorney rather than proceed with our self-service tools. We may decline to provide our Service for cases we determine are not suitable for self-service document preparation.

5. Account Terms

Account Creation

You must create an account to access paid features. We offer authentication through Google OAuth, Apple OAuth, and email magic link. You are responsible for maintaining the security of your account credentials. You may not share your account with others or use the Service to prepare applications for others commercially.

Account Data

Your account stores personal information including assessment responses, wizard data, generated documents, and checklist progress. See our Privacy Policy for complete details on data handling.

6. Intellectual Property

Our Content

All content on the Platform, including text, graphics, logos, software, document templates, and user interface design, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

Your License

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial use and to download and print documents generated for your own visa application.

You May Not

  • Reproduce, distribute, or create derivative works from our content
  • Use our Service to prepare applications for others commercially
  • Reverse engineer or attempt to extract source code
  • Remove or modify any proprietary notices
  • Share your account credentials with others

Your Content

You retain ownership of documents and information you upload. By using the Service, you grant us a limited license to store, process, and use your content solely to provide the Service.

7. Payment Terms

Pricing

Our Service is offered as a one-time purchase at $399 per household (primary applicant plus spouse and dependents). Payment is processed securely through Stripe. All fees are in U.S. Dollars unless otherwise stated. We do not charge recurring or subscription fees.

Price Lock

Your purchase price is locked at the time of payment. Future price changes for new users do not affect your access.

9. Partner Services and Affiliates

Third-Party Referrals

We may refer you to third-party services at natural points in the visa preparation process, including:

  • Wise: International banking and EUR transfers
  • Feather: Health insurance (DGSFP-registered for Spain)
  • Translayte: Certified and sworn translation services

We also provide non-affiliate informational recommendations for services such as BBVA, Santander, Sanitas, DKV, apostille services, FBI background checks, and local gestorías.

Important Disclosures

  • These are independent businesses, not our employees or agents
  • We may receive referral fees or commissions from affiliate partners
  • We do not guarantee their services, pricing, or outcomes
  • You enter into separate agreements directly with these providers
  • We are not liable for their actions, services, or failures
  • Affiliate relationships do not affect the price you pay for partner services

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for visa denials, delays, rejections, or any immigration outcome
  • We are not liable for errors in government forms, requirements, or threshold amounts that may change after our last update
  • Our total aggregate liability is limited to the amount you paid for the Service
  • We provide the Service "as is" and "as available" without warranties of any kind, express or implied
  • We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages

11. Indemnification

You agree to indemnify, defend, and hold harmless Impossible To Name, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

12. Dispute Resolution

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in New York, New York, or at your election, via telephone or online.

Class Action Waiver

You and we each waive the right to participate in a class action, class arbitration, or other representative proceeding. Disputes must be brought in an individual capacity only.

Opt-Out

You may opt out of arbitration by sending written notice tolegal@impossibletoname.com within 30 days of first using the Service. If you opt out, disputes will be resolved in the courts of the State of New York.

13. Privacy and Data Protection

We collect and process personal information to provide our Service. See our full Privacy Policy for complete details. Key points include:

  • We encrypt sensitive data in transit (TLS/SSL) and at rest (AES-256-GCM)
  • We do not sell your personal information
  • We comply with GDPR for EU data subjects
  • We retain data for 2 years after account inactivity, then delete
  • You have rights to access, correct, and delete your data

14. Modifications

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email and/or prominent notice on the Platform. Continued use after changes constitutes acceptance.

Changes to Service

We may add or remove features, update visa pathway information as requirements change, modify or discontinue the Service with 30 days' notice, or change pricing for new users (your price is locked at purchase).

15. Termination

We May Terminate

We may suspend or terminate your account for violation of these Terms, fraudulent or illegal activity, abusive behavior toward our team or partners, attempting to use the Service for edge cases after being filtered, or non-payment.

You May Terminate

You may close your account at any time by emailing support@impossibletoname.com. Refunds are subject to our Refund Policy.

Effect of Termination

Upon termination, your access ends immediately. You may download your data within 30 days. We will then delete your data per our retention policy.

16. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
  • No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.

17. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
