How Do You Renew Spain's Digital Nomad Visa in 2026?

Spain's digital nomad visa renews in two-year cycles, and the legal test is a single sentence: you keep the authorisation as long as the conditions that generated the right are maintained. That is the whole statutory standard. What changes at renewal is not the bar — it's the evidence. Your first application asked you to demonstrate that you would meet the conditions. Renewal asks you to prove that you did, using two to three years of Spanish paperwork you either kept or didn't.

The first cohort is arriving now. The regime came into force on December 23, 2022; people who applied through a US consulate in 2023 received a one-year visa, converted it to a three-year residence authorisation, and reach their first renewal in 2026.

Here is the structure, what's actually codified versus what's administrative practice, and the one thing almost every guide gets wrong.

What Is the DNV Renewal Structure?

The permit runs on a 1 + 3 + 2 + 2 pattern, set out in articles 74 quater and 74 quinquies of Ley 14/2013, as inserted by Ley 28/2022:

If you applied from inside Spain rather than through a consulate, you skipped the one-year visa and started directly on the three-year authorisation.

The conversion step has a hard, codified deadline: you apply within the 60 calendar days before your visa expires (Art. 74 quater.3). Immigration firms report the same 60-day window for the later two-year renewals, though that specific application isn't spelled out in the statutory text the way the conversion is — confirm the current window on the UGE-CE portal before you diarise it.

At five years of legal residence you become eligible for long-term residency, which ends the renewal cycle entirely.

What Does the Law Actually Require at Renewal?

Article 74 quinquies says renewals are granted "siempre y cuando se mantengan las condiciones que generaron el derecho" — provided the conditions that generated the right are maintained. That's it. There is no itemised statutory checklist.

That matters, because most of what you'll read about DNV renewal is not law. It's administrative practice reported by immigration firms based on what UGE-CE has actually asked their clients for. It's useful, it's probably accurate, and it is not the same thing as a codified requirement — which means it can shift without a legislative change, and it can vary between files.

With that caveat firmly in place, the areas practitioners consistently report being examined:

Continued income above threshold. Payslips or invoices plus bank statements showing the money actually arrived, across the whole period rather than a snapshot.

Social Security compliance. Whether you registered correctly and stayed current. Autónomos are looking at RETA contributions; employees at their employer's or their own arrangement.

Tax compliance. Whether you filed what you were supposed to file, on time, with the Agencia Tributaria.

Effective residence. Empadronamiento, utility bills, lease history — evidence that you actually lived in Spain rather than holding a Spanish permit while living elsewhere.

That last one is where the widely repeated advice goes wrong.

The 183-Day Rule Is a Tax Rule, Not an Immigration Rule

Search "Spain DNV renewal" and you will be told you must spend 183 days a year in Spain or lose the permit. That figure is real, but it is not an immigration requirement.

The 183-day test comes from Article 9 of the Spanish personal income tax law (LIRPF). It determines whether you are a Spanish tax resident: more than 183 days in a calendar year, counting sporadic absences unless you can prove tax residency elsewhere. It is a tax-residency trigger, not a codified day-count condition on the residence authorisation.

The reason it still matters is more interesting than the myth. The DNV exists so you can telework from Spain. Spanish tax residency is the natural evidence that you are, in fact, doing that — so being a tax resident and being able to show it supports the "conditions maintained" test, and failing to be one invites the question of where you were actually living. The relationship is real. The rule is not the one you've been told.

Practically: don't manage your calendar to a 183-day immigration cliff that doesn't exist. Do keep your padrón current, keep your Spanish tax filings clean, and be able to account for long absences.

The honest reframe: renewal is a documentation exercise, not a re-audition. Nobody is re-deciding whether you deserved the visa. If you registered properly, filed your quarterlies, and lived in the country, this is an administrative errand. The people who find it stressful are the ones discovering in month 34 that they never quite sorted out something in month 4.

What Are the 2026 Income Figures?

Spain's minimum wage (SMI) for 2026 is €1,221 per month, set by Real Decreto 126/2026 and published in the BOE on February 19, 2026, retroactive to January 1.

The DNV threshold is 200% of the SMI, with supplements of 75% for the first dependent and 25% for each additional one. Here is the wrinkle: the SMI is stated in 14 annual payments, so "200% of SMI" has two defensible readings, and official sources are not consistent. Annualising it (€1,221 × 14 ÷ 12 = €1,424.50, doubled) gives €2,849 per month. Reading it as a straight monthly figure gives €2,442 — and at least one consulate's own page uses that lower number.

We use the higher figure throughout, because clearing €2,849 satisfies both readings and clearing €2,442 might not:

At renewal the question is whether you stayed above the line, not whether you crossed it once. If your income is close to the threshold, the record of the whole period matters more than any single month.

What Happens While Your Renewal Is Pending?

Your existing authorisation's effects continue while a timely-filed renewal is processed — you don't fall out of status on the expiry date because the administration is slow.

Spanish immigration law also applies positive administrative silence to residence renewals: under the first additional provision of LO 4/2000, if the administration doesn't resolve within three months, the application is deemed approved. That is a genuine protection, not a technicality.

The condition attached to all of it is that you filed on time. Miss the window and you're in a materially worse position.

What to Do If Your Renewal Is 12 Months Out

The work is retrospective, which means the useful moves happen early:

  • Pull your own file first. Request your Social Security contribution history (informe de vida laboral) and check it says what you think it says. People discover gaps here, and a gap is much easier to explain than to fix.
  • Get a certificate of tax compliance. A certificado de estar al corriente from the Agencia Tributaria tells you now what a reviewer would see later.
  • Renew your empadronamiento. It expires, and an expired padrón is a bad look on a file that's meant to prove continuous residence. Our guide to the padrón covers the mechanics.
  • Reconstruct your income record. Every invoice or payslip, and the bank statement showing it landed. Assemble it while you can still remember which client was which.
  • Account for long absences. If you spent three months elsewhere, have the reason and the dates written down.
